A Computer-Related Invention (CRI) refers to any technological invention that involves the use of computers or computer programs.

CRI Guidelines for Patent Examination in India

  1. Patentability Criteria: Novelty, Inventive Step, Industrial Applicability, Non-Excluded Matter
  2. Exclusions for Computer-Related Inventions: According to Section 3(k) of the Indian Patents Act, 1970, inventions related to software per se or mere algorithms are not patentable.
  3. Assessing Technical Contribution: The most crucial step is evaluating whether the invention contributes something technical.
  4. Role of Hardware in CRI Patents: For CRIs that involve software, the presence of hardware elements plays a significant role.

Patentable vs Non-Patentable CRIs

Patentable: Software controlling a machine for improved precision, algorithm improving data processing, security systems using software and hardware integration
